1. Acceptance of the Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and MusclAI ("we," "us," or "our"), concerning your access to and use of the musclai.app website as well as any mobile applications related, linked, or otherwise connected thereto (collectively, the "Service").

By registering an account, utilizing the app for gym training, accessing at-home workouts, or receiving automated coaching routines, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree to all these terms, then you are expressly prohibited from using the service and must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms.

2. Core Warnings Regarding Artificial Intelligence (AI)

The primary differentiator of MusclAI from conventional fitness platforms is our deep integration of algorithmic and generative Artificial Intelligence to plan workouts and progressive overload schedules.

• AI Data Inaccuracies: You explicitly acknowledge that AI systems are probabilistic machines. The outputs, fitness advice, rep-ranges, dietary estimations, and recovery projections generated by our algorithms may sometimes be inaccurate, logically flawed, or temporarily out-of-context.
• Lack of Human Review: The vast majority of standard programs generated on the platform are not individually double-checked by a human certified personal trainer or medical professional. You are responsible for executing good judgment when interpreting AI suggestions.
• User Validation: If the AI suggests a lift, weight, or movement that feels excessively dangerous, painful, or unrealistic, you must ignore the AI's instruction. User safety is paramount.

MusclAI is continually learning and evolving. While we strive for high accuracy, the generative nature of AI means we cannot guarantee the absolute precision of every output.

3. Not Medical Advice Disclaimer

The fitness programs, dietary guidelines, and coaching suggestions generated by MusclAI are strictly for informational and educational purposes only. We are not a medical service.

None of the Services should be interpreted as medical advice, diagnosis, or treatment. You should always consult with your physician, physical therapist, or qualified healthcare provider before beginning any new exercise regimen, particularly if you have pre-existing cardiovascular ailments, musculoskeletal conditions, or metabolic restrictions. By using this service, you assume all risks involved with physical exertion.

4. User Consent and Assumption of Risk

By relying on any information provided by MusclAI, you do so entirely at your own risk. Exercise carries an inherent risk of injury. In using our application, you formally consent to this reality.

You agree to waive any civil claims, liability, or legal actions against MusclAI, its engineers, or its corporate entities resulting from injuries, adverse medical conditions, or loss of life sustained while executing tasks or workouts directly or indirectly recommended by our AI framework.

You certify that you are in good physical condition and have no medical or physical conditions that would prevent you from participating in fitness activities. If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, you should stop immediately.

5. Reaffirmation of Data Privacy

As articulated extensively in our Privacy Policy, your user data is not sold. We uphold the strictest standards against data brokering and personal health metric commercialization. Your usage of the site represents an agreement to the data handling procedures outlined in that sister document.

6. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, software interfaces, app designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us.

You are granted a limited license to access and use the Site and to download or print a copy of your personal fitness program for personal, non-commercial use. No part of the platform's core algorithmic interface may be crawled, copied, reverse engineered, or reproduced for commercial gain.

7. User Representations and Account Registration

By using the Site, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete.
2. You will maintain the accuracy of such information and promptly update such registration information as necessary.
3. You have the legal capacity and you agree to comply with these Terms of Service.
4. You are not a minor in the jurisdiction in which you reside.
5. You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.
6. You will not use the Site for any illegal or unauthorized purpose.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site.

8. User Interactions and Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Site, you agree not to:

• Submit explicitly malicious or illicit material to our servers.
• Attempt to "jailbreak" or execute prompt injection attacks on our AI models to bypass safety rails.
• Use the application to harass, abuse, or harm other users.
• Interfere with or computationally overload our network security layers.
• Circumvent, disable, or otherwise interfere with security-related features of the Site.
• Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use of the Site.

Violation of these rules will result in immediate Account Termination and forfeiture of any subscription payments.

9. Payment, Subscriptions, and Cancellation

Certain features on MusclAI require a paid subscription. All subscriptions auto-renew according to the cycle selected during checkout. We use third-party payment processors (e.g., Stripe) to handle billing securely.

Trial Periods: We offer a trial period where you will not be billed until the duration ends. You may cancel instantly via the Settings panel at any point during this period without incurring charges.

Upon cancellation, your premium access persists until the end of your billing cycle. We do not provide prorated refunds for mid-cycle cancellations, unless explicitly required by applicable local consumer laws.

We reserve the right to change our subscription prices at any time. We will notify active subscribers of any changes beforehand, allowing you time to cancel if you do not agree to the new rate.

10. Modifications and Interruptions

We cannot guarantee the Service will be available at all times. We may experience hardware, software, API outage, or server-side issues resulting in downtime. We reserve the right to change, revise, update, suspend, or discontinue the Site at any time without notice. You agree that we have no liability whatsoever for any loss resulting from your inability to access the Platform during any downtime or modification of the services.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and defined following the laws of the jurisdiction in which MusclAI Fitness Inc. operates, irrespective of conflict of law provisions.

Disputes arising from these terms will be handled primarily through binding arbitration prior to formal court proceedings. You agree to waive any right to participate in a class-action lawsuit. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts located in our operating jurisdiction, and the parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.

12. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Site; (3) breach of these Terms of Service; (4) any breach of your representations and warranties set forth in these Terms of Service; (5) your violation of the rights of a third party, including but not limited to intellectual property rights.

13. Severability

If any provision or part of a provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Service and does not affect the validity and enforceability of any remaining provisions.
